AEW has been involved in a legal battle featuring Luchasaurus’ mask and now it seems the company wants the court to dismiss five charges in the aforementioned lawsuit featuring Luchasaurus.
As previously reported, on December 20, Composite Effects, LLC filed a legal complaint against AEW and wrestler Austin Matelson Luchasaurus) alleging that the design of the Luchasaurus mask is protected by copyright and that it is being used for merchandise without the designer’s permission.
The latest update on this ongoing legal battle is that AEW has moved to dismiss five of the six counts raised by Composite Effects. According to Brandon Thurston of WrestleNomics, AEW has objected to the five counts on the grounds that they either fail to make a viable claim or are preempted by the Copyright Act.
It’s important to note that AEW has stated that it will answer the remaining count after a decision is made on this motion. The legal representation for AEW has listed the five objections, which include CFX’s failure to state a claim for unfair competition under the Lanham Act, CFX’s failure to state a claim under the Louisiana Unfair Trade Practices Act, and CFX’s conversion claim being preempted by the Copyright Act. Additionally, AEW claims that CFX’s unjust enrichment claim and claim for liability for acts causing damages are also preempted by the Copyright Act
